Custody of the child in Hawaii
In the state of Hawaii, joint legal, joint physical or sole child custody can and will be awarded to either or both of the parents or another person entirely based upon what would be in the best interests of the child or children and upon the wishes of a sufficiently mature child.
The parent who has previously had custody of the child in a happy and healthy home and is considered an overall proper parent is assumed to be the preferred custodian. Joint custody is allowed if it is arranged to assure the child’s continuing contact with both parents.
The court can order an official child custody investigation and report if it is deemed relevant to the particular case. Grandparents or other significant family members may be awarded visitation.

Rules for child support in Hawaii
Hawaii’s standard child support rules and regulations will apply in almost every divorce case, barring extraordinary circumstances. Both parents’ gross incomes and some child-related expenses will be considered as the child support is calculated. Child support continues until the child reaches age 18 and may extend until the completion of secondary education in some cases.
The court can at times order both or either parents to provide child support in an equitable manner. Factors that would be considered include:
Earnings and existing resources of the parents;
The potential earnings and reasonable necessities as well as borrowing capacity of the parents;
The continuing needs of the children;
The amount of public aid the children could be eligible to receive without any child support;
Any additional dependents of the parents;
Incentives given to both parents to work;
Attempts to balance the standards of living of the parents to avoid placing either parent below the poverty line; and
Attempts at avoiding an extreme change in either parent’s income.
If a parent with school-age children could work and chooses not to, 30 hours of minimum wage income would be added to that parent’s assumed income.

Hawaii is considered to be an “equitable distribution” state. The court will distribute all property of the two spouses, to include community, joint, and separate property, in a manner they believe to be equitable and just, based on the following factors:

The relative positions and abilities of the spouses;
The respective merits that the spouses present; and
